If another person’s purposeful conduct result in you being injured or harmed, that person is responsible for the injuries he/she cause you, and the changes for your future. Though the way the injury came to pass is straight forward, assault cases present their own unique issues. The first “identification”, when the assailant is a stranger. The second issue is often a conflict in how the event came to pass, and the extent to which either or both people contributed to the fight. This can be very challenging if the assailant is a person of authority, such as a police or security guard who uses excessive force. There is also the issue of whether the assailant will be in any position now or in the future to pay for the damage caused. Insurance policies will not cover a person’s willful act to harm another.

Often, this last issue requires an investigation into the broader contributing factors that lead to the assault. Did a bar over-serve a customer? Did a youth group mix the big kids with the little kids? Did a sense, let a sparring match escalate? Did parents not supervise their aggressive child? Did a school not deal properly with bullying?
